TECHY SA TERMS AND CONDITIONS
These Terms and Conditions (“T’s & C’s”) govern your use of the services provided by Techy SA Proprietary Limited (“Techy SA”/ “we”/”our”)) including our website, in-store services, and any related communications. By using our services, you agree to be bound by these T’s & C’s.
Techy SA services includes the sale of mobile devices and accessories, trade-ins and repairs.
- QUOTATION TERMS AND CONDITIONS
These terms apply to all product and service quotations issued by Techy SA.
- Validity of Quotation
- All quotations are valid for (seven) 7 days from the date of issue unless otherwise stated.
- Prices and availability are subject to change after the validity period expires.
- Product Availability
- Quoted items are subject to stock availability at the time of order.
- If a product becomes unavailable, we will offer a suitable alternative or revise the quotation accordingly.
- Pricing
- All prices are in RANDS and include VAT.
- Pricing errors or omissions are not binding and may be corrected.
- Acceptance of Quotation
- A quotation must be accepted in writing or via email, and an official purchase order or proof of payment may be required to confirm the order.
- No product will be reserved without a formal acceptance or deposit payment, if applicable.
- Delivery and Lead Times
- Delivery and lead times are estimates and begin once payment is confirmed.
- Delays due to suppliers, customs, or external factors will be communicated as they arise.
- Quotation for Services
- Service-related quotations are based on initial assessments. Final costs may vary based on actual work required.
- Any additional costs identified during service will be communicated for approval before proceeding.
- Cancellations
- Once accepted, cancellations may be subject to a restocking or cancellation fee.
- Custom orders, configured products, or special requests cannot be cancelled once confirmed.
- RETURN AND REFUND CONDITIONS:
- You can return an unwanted product, provided the following conditions are met:
- the product is unopened, unused, and undamaged, with all original labels and stickers attached;
- all accessories, parts and manuals must be included and returned with the product;
- the product is returned to the store with the original invoice within seven (7) days from purchase, alternatively, you can log a return on the website.
- Where a product is returned, it must be in the original packaging, which must be in perfect condition with seals intact (for most products).
- If the packaging is opened, a 20% handling fee may be charged by Techy SA. However, no refunds will be issued for products that are damaged or tampered with.
- Returns effected after seven (7) days will only be accepted if the product is defective.
- STRICTLY NO REFUNDS ON PHONE CASES AND SCREENGUARDS.
- You can return an unwanted product, provided the following conditions are met:
- REFUND & EXCHANGE PROCESS
- Once Techy SA approves your return, you can elect to get a full refund of the purchase price paid , exchange the product for another product or receive a voucher (store credits) to the value of the return.
- Should you elect a refund, your account will be credited with the purchase price within 10–14 working days (for EFT, cash refunded immediately).
- Should you choose to exchange the product:
- if the new product is more expensive, you will be required to pay in the difference;
- if it’s cheaper, Techy SA will give you a voucher(store credits) for the difference.
- RETURN AND REFUND EXCLUSIONS
- The following products cannot be returned:
- Unsealed/opened software
- Software subscriptions/downloads
- Gift cards
- In-ear headphones
- The following products cannot be returned:
- ADDITIONAL TERMS RELATING TO RETURNS AND REFUNDS
- All returned items will be inspected first.
- For purchases made via bank card, any applicable banking fees will be deducted from the refund amount. Refunds for cash purchases will be issued at the full original purchase price.
- Should you elect to make use of Techy SA’s collection services, a R100 courier fee will apply.
- No refunds or exchanges will be accepted for incompatible products, so confirms specifications before purchase.
- Refunds or exchanges for used or damaged items may be rejected at the discretion of Techy SA. If a product is found to be defective, it may be eligible for repair or replacement, depending on the circumstances, which shall be at the sole discretion of Techy SA.
- TRADE IN TERMS AND CONDITIONS
- Definitions
- “Buyer” means Techy SA;
- “Seller” means the person making use of the trade in service of the Buyer;
- “Device” means the second-hand electronic device owned by the Seller and offered to the Buyer
- Trade-in of Devices
- The Seller agrees to trade in and the Buyer agrees to accept the Device listed in TECHY POS TRADE IN WIDGET.
- The Seller warrants that they are the rightful owner of the Device/s and have the legal right to trade them in, with no outstanding financial obligations, liens, or claims against them.
- Trade-In Value & Payment
- The Buyer will assess the Device/s and determine the trade-in value based on the condition, age, market demand, and any other relevant factors.
- The Buyer will make an offer to the Seller which will be open for acceptance by the Buyer.
- The trade-in value is final once agreed upon.
- The Buyer reserves the right to adjust the trade-in value if the Device/s do not meet the described condition or specifications.
- Condition & Inspection
- The Buyer reserves the right to inspect the Device/s before acceptance. If any discrepancies are found, the Buyer may adjust the trade-in value, reject the Devices, or renegotiate new terms.
- The Devices must be reset to factory settings, with all personal data removed. The Seller acknowledges that the Buyer is not responsible for any data left on the Devices.

- No Warranty & Liability
- The trade-in is final, and the Seller relinquishes all claims to the Devices upon acceptance by the Buyer.
- The Buyer does not provide any warranties or guarantees regarding future resale value or usability of the Device/s.
- The Seller warrants that the Device/s are not lost, stolen, or blacklisted. The Buyer reserves the right to request documentary evidence proving ownership.
- If any Device is found to be blacklisted, the Buyer reserves the right to cancel the trade-in, seek a refund, or take legal action against the Seller.

- Transfer of Ownership
- Upon acceptance and completion of the trade-in transaction, ownership of the Device/s transfers to the Buyer, and the Seller has no further rights to the Device/s.
- The Seller agrees to provide any necessary documentation to facilitate the transfer of ownership.
- Indemnification
The Seller hereby indemnifies and holds the Buyer harmless from any claims, disputes, or legal action arising from prior ownership, third-party claims, or misrepresentation of the Devices’ status.
- PRE-REPAIR TERMS AND CONDITIONS
- All repairs include a 90-day warranty, covering both parts and labour for any defective parts replaced during a repair.
- This warranty strictly applies only to the specific parts repaired and faults related to the repair. It does not extend to any other components of the device or cover new physical damage, liquid damage, or issues caused by accidental misuse after the repair has been completed.
- The warranty will be considered null and void if the device is repaired or tampered with by a third-party service provider, the warranty seal is damaged, or if any software modifications are made after the repair.
- A watch that is waterproof or water-resistant may lose its resistance once it has been opened or repaired.
- While we take the utmost care during repairs , we are not responsible for any data loss, customers are strongly advised to back up their data before bringing in their devices for repair.
- Liquid-damaged devices are unpredictable, and while repairs may temporarily restore functionality, there is no guarantee of long-term performance. Corrosion and internal damage can continue to develop over time, even after successful repairs. Due to this, we do not provide a warranty on liquid-damaged devices, nor are we responsible for any further issues that may arise after repair.
- A non-refundable diagnostic fee is charged for all repair assessments. This fee covers the time and expertise required to diagnose the issue, regardless of whether the repair is successful or if the customer decides not to proceed with the repair. The diagnostic fee also serves as a deposit and will be deducted from the final quotation should additional parts or labour be required.
- Any additional issues found or new problems that arise after the repair, unrelated to the original service request, may require further diagnostics and may be subject to additional charges.
- Any repairs or services required on the device that fall outside the scope of our warranty will be provided with a separate quotation.
- Devices with cracked LCD screens, lenses, touch screens, and back covers are at risk of further damage or disintegration during disassembly and, as such, cannot be returned in the same condition as when received.
- The customer must ensure that all removable media, including DVDs, CDs, PC cards, SIM cards, stylus pens, and cases are removed before brought in for repairs
- Techy SA will record the condition of the device on the repair form. However, it remains the customer’s responsibility to provide proof that the device did not have any pre-existing defects at the time of submission.
- The availability of spare parts is dependent on the manufacturer’s supply, and as such, Techy SA cannot guarantee the availability of parts. Should a repair take longer than expected, the customer acknowledges that Techy SA will not be held liable for any damages or inconveniences resulting from a delay in the return of the device.
- To comply with applicable legislation, Techy SA is not obligated to return devices that are found to be blacklisted unless the customer can provide valid proof of ownership.
- A mandatory diagnosis fee is charged, which serves as a non-refundable deposit. If the repair quote is accepted after diagnosis, the diagnosis fee will be deducted from the final quoted amount. Payments must be made in full before the device is collected. If payment is being made via EFT, the payment must be cleared and confirmed by the store prior to collection.
- The customer acknowledges that by submitting their device for repair or service, the device will be used as collateral for the payment of the repair or service fees to Techy SA.
- To process the repair or replacement of the device, TECHY South Africa will need to handle the customer’s personal information. This may involve the collection, storage, use, retention, and sharing of such information. Contact details will be used to communicate with the customer throughout the repair process. The customer’s personal information may also be shared with TECHY South Africa partners, associates, or third-party service providers, as well as any other parties who have a legitimate reason to access the information. The customer agrees that their personal information may be stored in TECHY South Africa database and used for legitimate purposes at TECHY South Africa discretion. By providing their information, the customer consents to its processing by TECHY South Africa and third parties involved in the process. The customer also releases TECHY South Africa from any liability under the Protection of Personal Information Act No. 4 of 2013 (POPI) for not obtaining additional consent or informing the customer about the processing reasons.
By signing this document, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined above AND acknowledge that this form indemnifies and holds TECHY South Africa harmless against all damages, harm and loss howsoever arising with reference to the afore mentioned.
7 POST-REPAIR TERMS AND CONDITIONS
- All repairs include a 90-day warranty, covering both parts and labour for any defective parts replaced during service.

- GENERAL TERMS AND CONDITIONS
- Privacy
To enable Techy SA to render any service to the customer, it will be required to process the customer’s personal information. Contact details will be used to communicate with the customer relating to a service. The customer’s personal information may also be shared with Techy SA’s partners, associates, or third-party service providers, as well as any other parties who have a legitimate reason to access the information. The customer agrees that their personal information may be processed and used for legitimate purposes. By providing their information, the customer consents to the processing of its personal information by Techy SA and any relevant third parties.
- Governing Law
These T’s & C’s shall be governed by and construed in accordance with the laws of South Africa.
- Entire Agreement
These T’s & C’s constitute the entire agreement between you and us relating to our services and supersede all prior communications, whether oral or written.
- Severability
If any provision of these T’s & C’s is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
- Changes to these T’s & C’s
We may update these T’s & C’s periodically. Changes will be posted on our website with an updated “Last Updated Date.” Continued use of our services constitutes acceptance of the updated T’s & C’s.
- Indemnity
To the extent permitted by applicable legislation, you hereby indemnify and hold Techy SA harmless against all damages, harm and loss howsoever arising with reference to the services provided for herein.
